Here is a summary of the most important legal information:
Marital status
Fertility treatment is only provided to married couples or couples who are living in a registered partnership or domestic partnership. For couples in a domestic partnership who are neither married nor in a registered partnership, a notarial deed is required before medical treatment can commence.
PLEASE NOTE: In the case of insemination or IVF with donor sperm, as well as IVF with donor eggs, even married and registered couples must provide a notarial deed.
Lesbian couples
Since 2015, lesbian couples have had the option of making use of donor sperm for a fertility treatment. Detailed consultation with a notary in advance is required for this.
A child conceived using donated sperm may, on reaching the age of 14, access the relevant records of the Fertility Center in order to learn the identity of their biological father.
IVF and ICSI
These procedures may only be carried out by specially trained physicians and embryologists at hospitals with the appropriate certifications.
Preimplantation diagnostics
Preimplantation diagnostics are only permitted if
- no pregnancy could be brought about after 3 or more embryo transfers;
- at least 3 medically verified miscarriages or stillbirths have occurred spontaneously;
- based on the genetic disposition of at least one parent, there is a serious risk of a miscarriage, stillbirth or a hereditary illness.
